EXECUTIVE SESSION
Minutes of Meeting
March 4, 2010
Mayor Don Haddix called the executive session to order immediately following the
regular meeting on Thursday, March 4,2010. Council Members present were: Vanessa
Fleisch, Erik Imker, Kim Leamard, and Doug Sturbaum. City Manager Bernard
McMullen and City Attorney Ted Meeker were also present.
McMullen updated Council on the proposed improvements to the Peachtree
ParkwaylWalt Banks intersection, noting that the design firm had gone out of business.
The project engineer was working with a new firm, and the City was negotiating with the
new firm. The project had been in preliminary design. The intersection grade was
currently a C and, according to the traffic study, would be an F in 2027. He continued
that, per the traffic study, the traffic on Peachtree Parkway increased 2% each year, with
a possible increase of 40% by 2027. McMullen said staff did not see that occurring. The
intersection improvements would require an unfriendly right-of-way acquisition. To
date, $74,000 had been spent on the design. The estimated cost was originally $692,000,
and kept increasing. There were three sources of funding - Special Local Option Sales
Tax (SPLOST), Q23 funding (federal transportation funds dispensed by the Atlanta
Regional Commission), and the Lexington Circle developer, who had gone bankrupt.
r- The $147,000 in SPLOST funds set aside would increase to over $300,000 if the City
moved forward with the project. He added that right-of-way and a slope easement would
be required from the Brown property located at the intersection, and the vast majority of
trees on the property on both the Walt Banks and Peachtree Parkway side would have to
be removed. McMullen said the property needed for the right-of-way and slope easement
would most likely have to be condemned and he was concerned with justification since
the warrants probably would not be met until 2027. He recommended stopping the
project. The general consensus was to do so. There would be further discussion during
the Council Retreat.
Sturbaum moved to reconvene in regular session at 9:26 p.m. Leamard seconded. The
motion carried unanimously.
