Minutes of Executive Session
August 18, 2011
The Mayor and Council of the City of Peachtree City met in Executive Session on Thursday,
August 18, 2011, in City Hall Council Chambers. Council entered Executive Session at 7:40 p.m.
Those present were: Mayor Don Haddix, Council Members Vanessa Fleisch, Doug Sturbaum, Kim
Learnard, and Eric Imker; City Manager Jim Pennington; City Attorney Ted Meeker; System
Administrator Matt Robinson; and Public Information Officer/City Clerk Betsy Tyler.
Meeker reported that, at Council's direction, he had met with representatives of Fayette County
regarding the property exchange proposed for the right-of-way for TDK Boulevard. One of the
issues raised was that the property the County wanted to trade was wetlands. Theoretically, the
adjacent property owner or someone on the other side of Line Creek could go through the
extensive permitting process and get a crossing to extend the bridge.
Council discussed the impact on the Airport Authority. The authority had received grants based
on the old TDK Boulevard easement being abandoned, and there was always the possibility
those grants could be lost if the County used the existing TDK Boulevard easement to access
dam.
Meeker said Fayette County's response to the City's offer of paving the existing City-owned
segments and providing an easement was that the County already had an easement. Meeker
said they had also offered to put up a gate that would be locked at dusk, but there was no way
to guarantee that setup for any length of time. Meeker also pointed out that an alternate route
bypassed the City-owned parcels via Pathway Communities-owned section of Husky Drive.
However, the resulting rout would be very circuitous.
Meeker asked if Council wanted him to re-offer the paved easements to the County, noting the
City did not have to take action. The County wanted access to the dam. Inaction could have
implications down the road for the Airport Authority.
Council asked about exchanging property at another location, currently under litigation, with
Pathway Communities for the wetlands bordering Line Creek. Imker proposed an alternate strip
along the County roadway parallel to the Pathway property to the creek in conjunction with the
proposed strip, leaving no access to crossing the creek without crossing City property.
Council's preference remained to offer an access easement in lieu of the property exchange.
The second option was to talk to Pathway about the wetlands conveyance in exchange for the
contested property and to describe Imker's alternative.
Haddix asked about the existing TDK Boulevard easement. Meeker said it was only for Fayette
County, and would revert to the Airport Authority once the County had alternate access.
Imker moved to reconvene in regular session at 8:2 10-'57M. Learnard seconded. Motion carried
unanimously.
