<br />Dear Ms. Lariviere,
<br />
<br />On October 9,2007 a Stop Work Order was issued on your property due to a fence/gate having
<br />been built on your property at 233 Smokerise Trace. On October 12,2007, Rick Bazzill
<br />submitted a permit application for the gate/fence. On October 15,2007 a Statement of Refusal
<br />for the plans submitted to obtain a permit for the structure was issued because the fence/gate
<br />"exceeds allowable height in front yard per section 18-338 (front yard definition) and section 18-
<br />341(e) allowable height and design." On January 23, 2008 a Notice of Violation was given to
<br />have the fence/gate removed as you had no permit for it. On January 29, 2008, you submitted a
<br />request for variance to the code. On March 20, 2008, the City Council denied your request for
<br />variance unanimously with a 5-0 vote. On March 28, 2008, Acting City Clerk sent you a letter
<br />informing you officially that your variance had been denied.
<br />
<br />As of this date, no further action has taken place to cause the City to allow the fence/gate to
<br />remain on your property. As such, you are to remove the gate from the property and thus abate
<br />the violation. An inspection of the property will take place on Monday, June 2, 2008. If the
<br />fence/gate has not been removed, the City will take further action to ensure compliance with the
<br />ordinance.
