DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS

<br /> THIS DECLARATION is made this 21st day of October , 1985 by
<br />BOB DIXON BUILDER, INC., a Georgia Corporation, having its principal
<br />office at 695 N. Jeff Davis Drive, Fayetteville, Fayette County,
<br />Georgia (.hereinafter sometimes referred to as "the Declarant").
<br /> WI TNES SETH:
<br /> WHEREAS, Declarant is the owner in fee simple of
<br />certain real property set forth and described in Exhibit "A" (such
<br />real property hereinafter sometimes referred to as the "subject
<br />property"), such Exhibit being attached hereto and by reference made
<br />a part hereof; and
<br /> WHEREAS, Declarant is desirous of Subjecting the subject
<br />property to the provisions of this Declaration in order to create a
<br />residential fee simple cluster home development.
<br /> NOW, THEREFORE, the Declarant hereby declares that the real
<br />property described in Exhibit "A" attached hereto, including the
<br />improvements constructed on or to be constructed thereon, is'hereby
<br />subjected to the provisions of this Declaration and shall be held,
<br />sold, transferred, conveyed, used, occupied, and mortgaged or
<br />otherwise encumbered subject to the covenants conditions,
<br />restrictions, 'easements, assessments, and liens hereinafter set
<br />forth, which are expressly made for the purpose of protecting the
<br />value and desirability of the subject property, and shall run with
<br />~he title to the subject property and be binding upon any and all
<br />persons and entities having any right, title, or interest in all or
<br />any portion of the subject property, together with their respective
<br />heirs, legal representatives, successors, and assigns and shall inure
<br />to the benefit of each and every owner of all or any portion thereof.
<br /> ARTICLE I
<br /> DEFINITIONS
<br /> Unless the context shall prohibit, certain words used in
<br />his Declaration shall have the definitional meaning set forth as ~
<br />follows:
<br /> (a) "Association" shall mean and refer to Dover Square
<br />Homeowners Association, Inc.
<br /> (b) "Board" shall mean and refer to the Board of Directors of
<br />the Association.
<br /> (c) "Common property" there shall be no common property or
<br />common areas.
<br /> (d) "Community" shall mean and refer to that certain real
<br />property and interests therein described in Exhibit "A" attached
<br />hereto, and such additions thereto as may be made by supplemental
<br />declarations of other real property. ·
<br /> (e) "Community-Wide Standard" shall mean the standard of-
<br />conduct, maintenance, or other activity generally prevailing in the
<br />community. Such standards may be more specifically determined by' the
<br />Board of Directors of the Association.
<br /> (f) "Declarant" shall mean and refer to BOB DIXON BUILDER,
<br />INC., a Georgia Corporation, and its successors in title and assigns,
<br />provided any such successors in title or assignee shall acquire for
<br />the purpose of development or sale all or any portion of the
<br />remaining undeveloped or unsold portion of the subject property, and
<br />provided further that in the instrument of conveyance to any such
<br />successor in title or assignee, such successor in title or assignee
<br />is designated as the "Declarant" hereunder by the Grantor of such
<br />conveyance, and such designation shall be consented to in writing by
<br />the Citizens and Southern National Bank so long as the Deed to Secure
<br />Debt executed by the Declarant herein in favor of Citizens and
<br />
