._D_ECLA~ATION OF COVENANT$~ CO~D!TIOIx].$ AND RESTRICTIONS FOR <br /> <br />SMOKERISE ESTATES, PHASE THREE <br /> <br />WHEREAS, the undersigned GIBSON BUILDERS, INC., is the sole owner of SMOKERISE <br />ESTATES, PHASE THREE, and <br /> <br /> WHEREAS, it is to the interest, benefit and advantage of the undersigned and each and <br />every person who shall hereafter purchase any lot in the said subdivision that certain covenants governing <br />and regulating the use and occupancy of the same be established, set forth and declared to be covenants <br />running with the land; <br /> <br /> NOW THEREFORE, in consideration of the premises, the undersigned GIBSON BUILDERS, <br />INC., for itself, its' successors and assigns, and its' future grantees, does hereby place and impose the <br />following conditions, restrictions, reservations, easements, liens and charges as detailed hereinafter on real <br />property located in the City of Peachtree City, County of Fayette, State of Georgia, and being more <br />particularly described as follows: <br /> <br /> All that tract or parcel of land lying and being in Land Lot 91 of the 7th <br /> District of Fayette County, Georgia, and being Smokerise Estates, Phase <br /> Three, .as shown on plat of survey of said subdivision recorded in Plat <br /> Bookl¥5, pages 72, 73 and 74, in the office of the Clerk of Superior Court <br /> of Fayette County, Georgia. <br /> <br /> The above described property is hereby subjected to the same covenants, conditions and <br />restrictions as previously set out for Smokerise Estates, Phase Two (which includes those for Phase One), <br />in an instrument filed and recorded in the office of the Clerk of Superior Court of Fayetle County, Georgia, <br />in Deed Book 852, page 162, which said covenants, conditions and restrictions (including those for Phase <br />One) are by relerence hereto incorporated herein as fully as if set out verbatim herein. <br /> <br />FILED L 2,:!,.i;ORDED <br />i' ',','~'i~T~!
