MacDuff Parkway - Phase2 / MAINTENANCE GUARANTEE THE UNDERSIGNED, ITS SUCCESSORS AND ASSIGNS, HEREBY WARRANTS AND GUARANTEES TO THE CITY OF PEACHTREE CITY THE FULL AND COMPLETE MAINTENANCE OF A CERTAIN IMPROVEMENT KNOWN AS MacDUFF PARKWAY - PHASE II AND MORE PMTICUlARL Y SHOWN IN PLAT BOOK , PAGE(S) OF THE FAYETTE COUNTY RECORDS. THIS WARRANTY AND GUARANTEE IS MADE IN ACCORDANCE WITH THE PEACHTREE CITY L4.ND DEVELOPMENT ORDINANCE. THIS GUARANTEE INCLUDES NOT ONLY PAVING BUT ALSO ALL OTHER APPURTENANT STRUCTURES AND AMENITIES LYING WITHIN THE RIGHT-OF -WAY OF SAID ROAD AND IN THE GREEN BELT INCLUDING BUT NOT LIMITED TO ALL CURBING, DRAINAGE PIPES, CULVERTS. CATCH BASINS, DRAlNAGE DITCHES, BIKE PATHS, CART PATHS AND PEDES- TRIAN PATHS. UTILITIES OWNED AND OPERATED BY A GOVERNMENTAL BODY OR PUBLIC UTILJrf COMPANY SHALL BE THE RESPONSIBILITY OF SAID GOVERMENTAL BODY OR PUBLIC UTILITY COMPANY AND NOT THE DEVELOPER. THE DEVELOPER SHALL CORRECT AND REPAIR, OR CAUSE TO BE CORRECTED AND REPAlRED. ALL DAMAGES TO SAID IMPROVEMENTS RESUUING FROM ANY CAUSE WHATSOEVER. IN THE EVENT THE DEVELOPER FAlLS TO CORRECT ANY DAMAGES WITHIN THIRTY (30) DAYS AFTER WRITTEN NOTICE THEREOF. THEN SAlD DAMAGES MAY BE CORRECTED BY THE CITY AND ALL COSTS AND CHARGES BILLED TO AND PAlO BY THE DEVELOPER; BUT THIS REMEDY SHALL NOT LIMIT THE CITY, AND IT SHALL ALSO HAVE N-~Y REMEDIES AVAILABLE TO IT AS APPROVED BY LAW. THE TERMS OF THIS AGREEMENT SHALL BE FOR A PERIOD OF TWO (2) YEARS BEGINNiNG ON THE DATE OF WRITTEN ACCEPTANCE OF SAlD IMPROVEMENTS BY THE CITY AS EVIDENCED BY THE FINAL PLAT APPROVAL OF SAlD COMPLETED IMPROVEMENTS. MAINTENANCE GUARANTEE (CONTINUED) AFTER THE TERMINATION OF SAlD TWO (2) YEARS PERIOD, THE CllY SHALL BE RESPONSIBLE TO THE CITIZENS OF PEACHTREE CITY FOR THE MAlNTENANCE OF SAlD IMPROVEMENTS AS PROVIDED BY LAW. NO ROADWAY AND ASSOCIATED RIGHT -OF -WAY SHALL BE ACCEPTED BY THE CITY FOR MAlNTENANCE UNLESS IT SCORES 90 OR ABOVE ON THE CITY'S ASPHALT PAVEMENT RATING FORM PROVIDED.
